During the execution of financial debt, if the person subject to enforcent objects on the grounds that the house in question is essential for their own and their dependents’ life needs, the People’s Court will not support it:
(1) If the person liable for support under the debtor’s na has another dwelling in which they can maintain basic living needs;
(2) After the enforcent basis has taken effect, if the debtor transfers other houses under their na to evade debts;
(3) If the applicant for enforcent has provided the debtor and their dependents with housing according to the local standards for low-rent housing area guarantees, or agrees to deduct five to eight years of rent from the proceeds of the house’s sale based on the average rent standard of the local housing rental market.
The first two are self-explanatory, the third ans that as long as the enforcer provides these guarantees, they can apply for execution!
The core point is simple: if you either provide a place to live or several years’ worth of rent, you can execute the debtor’s house.
